In San Mateo County Superior Court, the court granted summary judgment in favor of a mortgage servicer on a wrongful foreclosure claim involving compliance with the California statutory mailing requirements. Earlier, on successive demurrers, the court dismissed plaintiff’s causes of action for wrongful foreclosure based on alleged “dual tracking,” negligence, negligent infliction of emotional distress, and intentional infliction of emotional distress. The summary judgment victory was also upheld on appeal.
