Severson & Werson attorneys Joseph W. Guzzetta and Laszlo Ladi prevailed in a trial of multiple claims of violation of the California Homeowners’ Bill of Rights in a three-week jury trial in San Mateo County Superior Court. Mr. Guzzetta and Mr. Ladi represented a major national bank in a trial of claims that the bank, acting as loan servicer, had failed to engage in certain pre-foreclosure contact with the borrower required by California law, failed to send acknowledgements of receipt of loan modification-related documents, failed to assign a single point of contact to the borrower’s account, engaged in dual tracking in violation of California law and wrongfully foreclosed on the borrower’s home. After the three-week trial, the jury found unanimously in favor of Severson’s client on four of the five causes of action asserted by the borrower and voted 11-1 in favor of Severson’s client on the remaining claim. This victory continues Severson’s impressive string of trial successes in 2018.
