An order granting or denying a motion to disqualify counsel is immediately appealable as an order granting or denying an injunction and also is appealable under the collateral order doctrine.  When the appeal is from an order denying a motion to disqualify, the appeal does not stay any proceedings because the order does not alter the status quo.  However, an appeal from an order granting a motion to disqualify counsel automatically stays the effect of the disqualification order—but not other proceedings in the case—so disqualified counsel may continue in the case as it proceeds pending resolution of the appeal.
