CCP 995.240 grants a trial court authority to waive any provision requiring a litigant to post a bond if the trial court finds the party that is otherwise required to post a bond is indigent and unable to obtain sufficient sureties.  This decision holds that the statute applies, and grants the trial court discretion, to waive CCP 917.1’s otherwise applicable requirement that the judgment debtor post a bond to stay enforcement of a money judgment pending appeal.  Section 995.240 is intended to allow relief to the indigent and assure their rights are not sacrificed in litigation solely due to their indigency.  It does not conflict with CCP 917.1 or 918 which deal with all litigants, wealthy as well as not.
