The trial court in San Francisco abused its discretion in denying defendant’s motion to transfer this wrongful death case to San Diego where the accident occurred and most witnesses reside.  The fact that the Legislature authorized remote trial testimony through July 2023 is not a favor that the trial court could properly invoke to ignore the fact that most witnesses were in San Diego.  There is no guarantee trial will occur before expiration of the statute, and in any event the Legislature did not change the venue statute CCP 397 when it allowed remote testimony.  Although many facts leading up to the accident were undisputed, witness testimony was still material to the jury’s assessment of comparative fault.  The interests of justice would also be furthered by a San Diego trial as there is a local interest in litigation involving events in that area.
