The trial court did not abuse its discretion in awarding HSBC its full expert witness fees incurred after rejection of its 998 offer.  The expert’s testimony was used at trial.  His travel and meal expenses were also properly awarded as he came from Georgia to testify.  The trial court also did not abuse its discretion in declining to reduce the awarded expenses based on plaintiff’s financial condition.  She submitted a declaration addressing only income and expense, but not assets and liabilities.  So the trial court could conclude she hadn’t shown she couldn’t afford to pay the $34,000 in expert witness costs.
