The district court erred in entering judgment in favor of the defendant property owner in this ADA suit over  the parking lot’s lack of a space for parking a van with an access path for a person confined to a wheelchair.  The fact that plaintiff was a serial litigant in ADA cases was not a reason to deny him Article III standing, which he had so long as he observed the barrier to handicapped access and an intent to return to the attached business if the barrier were removed.  That plaintiff was a serial litigant was no reason to deny him standing or find his testimony untrustworthy.  The parking lot was a place of public accommodation subject to the ADA because it was actually used by customers of the Lobster Shop restaurant that did business in the adjacent building under a lease from the property owner.
