Under CCP 340.1(b), a plaintiff may obtain treble damages against a person whose cover up is found to be the cause of a sexual assault on a child through a concerted effort to hide evidence relating to childhood sexual assault.  This decision holds that the treble damage provision does not apply retroactively.  The statute espressly makes the lengthened statute of limitations in subdivision (a) retroactive, but not the treble damage provision of subdivision (b).  Also, the provision of a treble damage remedy represents a significant change to potential liability, not a mere procedural change, like a lengthening of the statute of limitations.  Furthermore, treble damages under 340.1(b) are available only when not prohibited by other law.  Gov. Code 818 bars punitive damage awards against governmental agencies.  It prohibits recovery of treble damages against a school district since the purpose of treble damages under section 340.1(b) is primarily punitive, not compensatory.
