A party seeking to correct or vacate an arbitration award must petition to correct or vacate or raise the issue in answer to the opposing party’s petition to confirm the award during the shorter of (a) 100 days from issuance of the arbitration award or (b) 10 days after the petition to confirm is served.  The 10 day limit may be extended by agreement of the parties or the court on a finding it would not prejudice the other party.  Here, the defendant filed an answer and petition to vacate less than 100 days after the award but more than 10 days after the petition to confirm.  Because the challenge to the award was untimely, the trial court was obligated to confirm the award, and the appellate court could not consider the defendant’s arguments against the award.
