Trial, Limited Jurisdiction Case, Request for Witness List, CCP 96, 1, 3

In a limited jurisdiction case, a party may demand that the opponent provide a list of the names and addresses of the witnesses it will call at trial.  CCP 96.  The demand must be served no more than 45 days nor less than 30 days before the initial trial date set in the case.  This decision holds that after a new trial motion is granted, the 45 and 30 day times are computed from the date initially set for the new trial, not the original one.  And, it holds that a response to a section 96 demand that states only “custodians of record” without giving their names and addresses does not comply, with the result that the trial court must exclude the unnamed custodians as witnesses.
