Following Keeton v. Tesla, Inc. (2024) 103 Cal.App.5th 26, 32, review granted 9/11/24, this decision holds that the FAA does not preempt CCP 1281.98 the statute that allows a non-drafting party to opt out of an arbitration agreement if the drafting party does not pay the arbitrator’s fees within 30 days. The decision also rejects several other arguments against enforcement of section 1281.98.
