Plaintiff recovered a $157,000 judgment against defendant’s corporation, then brought this independent suit against defendant claiming he was the corporation’s alter ego and liable for the judgment against it. On the first appeal from judgment on the pleadings against plaintiff, the court held that a plaintiff may pursue an independent action against the alter ego based on the judgment against the corporation; the plaintiff isn’t limited to moving to amend the judgment to name the alter ego as a judgment debtor. On remand, the trial court granted defendant summary judgment on the ground that since the original action against the corporation went by default, it would violate due process to bind the alter ego by the judgment. This decision reverses again, holding that if plaintiff proves defendant controlled the corporation’s response to the original suit, he is bound by the judgment even if it went by default.
