Joseph W. Guzzetta acted as first chair trial counsel in jury trial of claims under the California Homeowners’ Bill of Rights and claims for negligence and slander of title relating to the foreclosure of the plaintiff’s home. Plaintiff sought approximately a half-million dollars in actual damages, plus punitive damages. The jury returned a complete defense verdict on all six causes of action as to both of Mr. Guzzetta’s clients, and the bank obtained possession of the collateral after the trial. The jury instructions written by Mr. Guzzetta in this case will be featured as sample model instructions in the 2017 edition of the California Civil Jury Instruction (“CACI”) Companion Handbook written by Justice Elizabeth A. Baron (Ret.) and Judge Judy Holzer Hersher, the judge who tried the case. Mr. Guzzetta provided commentary to accompany the instructions. The Handbook is scheduled to be published in the Fall of 2017.
