Joseph W. Guzzetta acted as first chair trial counsel representing a major national bank in a jury trial in Los Angeles County Superior Court. The plaintiff sought over $45 million in damages, asserting claims for fraud, negligent misrepresentation, breach of contract, breach of the implied covenant of good faith and fair dealing, breach of fiduciary duty, wrongful foreclosure, violation of California’s unfair competition law and accounting. After a one week jury trial, the jury returned an unanimous verdict in favor of the bank on all of the legal causes of action, and the Court entered judgment in favor of the bank on all of the equitable causes of action, handing the bank a complete victory in the case.
