Following Badgerow v. Walters (2022) 142 S.Ct. 1310, this decision holds that the facts establishing a federal court’s subject matter jurisdiction must be evident on the face of the petition to confirm an arbitration award under 9 USC 9.  As Badgerow holds, a federal court may not “look through” the petition to confirm the award to review the underlying controversy to see whether it fell within a federal court’s jurisdiction.  Hence, this petition to confirm an arbitration award is vacated and dismissed for lack of jurisdiction.  The arbitration award was a defense verdict for $0, so it didn’t establish the $75,000 amount in controversy requirement for diversity jurisdiction, and the petition did not otherwise allege facts showing the required amount in controversy.
