Judgment, Vacating Judgment, Order Must Direct Entry Of New Judgment, CCP 663, 1, 5
This decision holds that even as amended in 2012, CCP 663a still requires the court to enter an order within 75 days that (a) vacates the previously entered judgment, and (b) orders entry of a new judgment. Failure to order both–especially entry of a new judgment–within the 75 days results in denial of the motion to vacate as a matter of law.
