This decision reverses a JNOV and new trial order overturning a jury verdict for plaintiff in this slip and fall accident caused by liquid on the floor tile of the defendant restaurant.  The plaintiff offered a reasonable explanation for how the ten foot long, ten inch wide strip of liquid got on the floor in a location leading past the bathrooms and toward the kitchen–namely, the liquid was dropped as an employee rolled a cart of dirty dishes to the kitchen to be washed.  If an employee left the liquid, the owner was liable even if without pre-accident knowledge of the dangerous condition.  The jury properly accepted that reasonable explanation in preference to the owner’s illogical attempts to blame the liquid on persons urinating before reaching the bathroom or other causes that didn’t match the evidence.
