A claim against the county for malpractice by the public defender at a probation revocation hearing is a tort claim, not a contract claim, and so under the Government Claim statute, the plaintiff had to file a claim with the county within six months after his claim accrued.  Here, he waited 11 months before filing his claim.  The trial court did not abuse its discretion in denying him leave to file a late claim.  Plaintiff’s evidence of an excuse for delay was not detailed or compelling.
