This decision holds that CRC 2.259(c) and 8.77(d) both apply to excuse late filing of notices of appeal in appropriate circumstances.  Rule 2.259(c) requires a court to deem a document filed on the day of the attempted filing if a technical problem with the court’s filing system prevents the filing.  Rule 8.77(d) allows a court to deem a document filed nunc pro tunc if “good cause” is shown based on “a failure at any point in the electronic transmission and receipt of a document.”  The decision holds that a motion for relief under Rule 8.77(d) must be filed in the appellate court, and the movant bears the burden of proving by a preponderance of the evidence that hat an attempt to electronically file the document was made prior to the expiration of the deadline and that diligence was shown in promptly filing the notice of appeal after the failed attempt.  Here, appellants did not make the required showing since they did not serve and file the notice of appeal promptly after the initial failure of the electronic transmission, but instead waited 29 days to try again.
