Mortgage Banking

Severson attorneys have been at the forefront of the expansion of mortgage banking fostered by enhanced technology and the growth of the secondary market. The firm provides a broad range of legal services to many of the nation’s largest mortgage banking companies as well as medium-sized and regional mortgage lenders. Members of the firm regularly speak at the Mortgage Bankers Association of America Legal Issues Seminar, and provide in house training programs for many clients.

Litigation

The firm’s attorneys have represented banks, consumer finance companies and mortgage banking companies in a variety of disputes in federal and state courts. Severson litigation teams have been involved in class actions [see Class Action Defense http://www.severson.com/practice/class_act_def.html] regarding claims brought under the Truth in Lending Act and Real Estate Settlement Procedures Act and other state and federal consumer protection statutes. We have defended and tried class action cases involving loan fees, late charges, early termination charges, so-called “junk fees,” security deposits, lien reconveyance practices, and collateral protection insurance. In addition, the firm has represented mortgage banking companies in complex disputes over secondary mortgage market issues, and in the defense of individual actions brought by borrowers, former employees, competitors and others.
