Defense Trial Victory: Claim of Land Surveyor Malpractice
(Last updated July 2, 2008)
Member Joel L. Halverson and Of-Counsel attorney Daniel Ng of Severson & Werson’s construction practice group secured a speedy defense judgment for a professional land surveyor in a Sonoma County Superior Court trial on June 17, 2008.
The case, Tri-Pacific, Inc. v. Ray Carlson & Associates, Inc., et al. (Sonoma County Superior Court Case No. SCV240914), involved an alleged surveyor's error with respect to a vineyard property. The plaintiff landowner claimed that the surveyor's alleged error resulted in a loss of land valued at over a quarter million dollars. Liability was hotly contested, and the Severson & Werson defense team quickly persuaded the trial court to sever the statute of limitations issue and prevailed on that defense after trial. |
