“Blackstone to Buzgheia: Law & Procedure in Assessing Special Damages,” Ryan C. Donlon & Austin B. Kenney publish article in ADC Comment

In the most recent addition of Defense Comment (vol. 22, no. 1, Spring 2007) the Association of Defense Counsel of Northern California and Nevada has included "Blackstone to Buzgheia: Law & Procedure in Assessing Special Damages”, the collective work of Severson & Werson attorneys Ryan Donlon and Austin Kenney. In their article, Messrs Donlon and Kenney review the development of special damages, particularly the accepted measure of recovery when a plaintiff has paid his or her medical service provider less than the costs actually incurred. Mr. Donlon and Mr. Kenney provide a historical perspective, tracing the doctrine from its common law inception through its most recent treatment by California appellate courts. They forecast the direction of these doctrines and provide advice for litigators on how to avoid pitfalls and best utilize court procedures and jury instructions.
