David A. Ericksen

David Ericksen leads the firm's construction/environmental litigation and transactional practice, as well as focusing on liability and insurance issues. He also focuses on contractual, risk management and litigation issues affecting the design and construction professional community.

Mr. Ericksen's substantive expertise includes the following areas:

  • Construction Litigation: Mr. Ericksen has represented design professionals, construction managers, developers and contractors in construction defect and delay claims.  He has served as lead trial and arbitration consel, as well as lead negotiator for mediated resolutions.
  • Transactional Counseling and Document Preparation: Mr. Ericksen has primarily focused on the construction and environmental fields, with an emphasis on contract preparation and negotiation, and risk management counseling and advice.
  • Risk Management Advice and Seminars: Mr. Ericksen is a frequent speaker and trainer regarding risk management issues for construction professionals
  • Environmental Litigation and Regulatory Compliance: Mr. Ericksen represents professionals and parties in transactions and litigation involving hazardous substances, hazardous wastes, pollutants, and regulatory issues.
  • Professional Liability: Mr. Ericksen defends architects, engineers, and other professionals against errors and omissions and other claims.
  • Insurance Coverage and Bad Faith: Mr. Ericksen advises insurers and insureds regarding coverage, as well as representing insurers and insureds in declaratory relief and coverage actions.
  • General Litigation: Mr. Ericksen represents plaintiffs and defendants in all manner of commercial, property, and casualty disputes.

Mr. Ericksen joined Severson & Werson in 1991, and has been a member since 1997.  .He has been the Firm's lead construction trial counsel since 1996.  He is a frequent speaker before construction professional organizations such as the AIA, SEA, CELSOC, CSI and others, and also provides in-house training seminars for firms. He has written numerous articles addressing issues important to the design and construction communities, such as "Email as a Project Communication Tool: Loose Fingers Sink Ships," "The Mold Menace: It's here! Are you ready?" "Managing the Risk in Construction Management," "Changing of the Guard: Dealing with the Transition Between Design Professionals," and "Getting Paid: Strategies to Secure Payment For Services Delivered."

Mr. Ericksen has been named a Northern Californian "Super Lawyer" for three consecutive years, is a member of the American Bar Association, has been part of the Design Steering Committee of the Forum on the Construction Industry Torts & Insurance Practices Section, and Vice-Chair of the ABA/TIPS Division of Environmental Laws.
