Austin B. Kenney is an Associate in the Firm’s San Francisco Office, where he is primarily involved in the following practices:
 
Financial Services Litigation Group: Mr. Kenney counsels and defends financial institutions in consumer and commercial litigation involving banking operations and mortgage, automotive and unsecured credit throughout California. He has particular experience in defending mortgage lenders and servicers in claims alleging fraud, predatory lending, wrongful foreclosure, unfair and deceptive practices, violations of TILA, RESPA, FDCPA, as well as claims involving title and servicing issues. Mr. Kenney also has experience with claims involving construction lending and counsels financial institutions regarding lending "best practices" and procedures.
 
Construction Practice Group: Mr. Kenney represents design professionals, homeowners, developers and investors in the litigation of construction defect and professional liability claims. He also provides advice and counsel to design professionals with respect to loss prevention, risk management, contractual and employment issues.
 
Mr. Kenney received his J.D. from the University of Colorado School of Law in Boulder, Colorado, where he earned course credit from the Strauss Institute for Dispute Resolution at Pepperdine University School of Law in Malibu, California. He was a participant in the Colorado Law Mediation Program, which provides mediation and conciliations services for the Community of Boulder. He was also a member of the Sports & Entertainment Law Society and a participant in the 2003 ABA Regional Negotiation Competition.
 
Mr. Kenney holds a B.A. from the University of California at San Diego, where he was on the Provost’s Honor Roll and a Warren College Scholars Program Invitee. He is admitted to the State Bar Association in the State of California and is admitted to all state and federal courts in California.
Mr. Kenney is a member of the firm's Construction Litigation Group.

Mr. Kenney's specific experience includes:
General Litigation. Civil litigation, in state and federal courts. representing plaintiffs and defendants in all manner of commercial, property, and casualty disputes. 
 
Construction Litigation. Representing design professionals, owners, developers, construction managers, and contractors in construction defect, errors and omissions and delay claims.
 
Financial Institution Litigation. Representation of financial institutions, primarily mortgage lenders, auto finance companies, and loan servicers, in suits raising a variety of lender liability claims. 
 
Business and Commercial Litigation. Prosecute and defend actions arising from complex business transactions, fiduciary relationships, partnerships, suretyships, employment termination, and business torts.   
 
Transactional Law. Assisting clients in contract interpretation, administrative procedure, and coordination of litigation settlements.   
 
Personal Injury. Defense of clients in the construction and entertainment industries in a wide variety of wrongful death and general personal injury tort litigation.
